WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNIFICATION AGREEMENT

I, the undersigned parent or legal guardian of the participant, hereby acknowledge and agree to the following terms and conditions in consideration of my child being allowed to participate in any program, activity, class, camp, clinic, league, or event operated by Soccer Heroes LLC, including but not limited to soccer, volleyball, tennis, fitness, and multi-sport activities.

1. Assumption of Risk

I understand that participation in sports and physical activities involves inherent and significant risks, including but not limited to: falls, collisions, overexertion, equipment failure, weather-related conditions, physical contact with other participants, and the risk of serious injury or death.

These risks include, but are not limited to: minor injuries, cuts, bruises, sprains, strains, fractures, concussions, paralysis, permanent disability, illness, emotional distress, or death.

I understand that these risks may result from:

• My child’s own actions or inactions

• The actions or inactions of other participants

• The actions or inactions of coaches, staff, volunteers, or third parties

• The condition of the facilities, fields, courts, or equipment

• Travel to and from activities

I freely and voluntarily assume all risks, both known and unknown, even if arising from the negligence of Soccer Heroes LLC or others.

2. Medical Fitness & Disclosure

I certify that my child is physically and mentally fit to participate. I agree to disclose any medical conditions, allergies, injuries, or limitations that may affect my child’s participation. I understand that Soccer Heroes LLC is not responsible for monitoring medical conditions.

 

3. Release of Liability

I hereby fully and forever release, waive, discharge, and hold harmless:

Soccer Heroes LLC, its owners, officers, directors, employees, contractors, coaches, volunteers, affiliates, partner schools, host facilities, property owners, sponsors, and any associated entities

from any and all claims, demands, damages, losses, actions, or causes of action, whether known or unknown, arising out of or related to my child’s participation, including those caused by the negligence of the released parties.

4. Indemnification

I agree to defend, indemnify, and hold harmless Soccer Heroes LLC and all related parties from any claims, damages, liabilities, costs, or expenses (including attorney’s fees) arising from:

• My child’s participation

• My child’s actions or behavior

• Any claim brought on behalf of or by my child or any third party​

• ​

5. Medical Authorization

In case of injury or emergency, I authorize Soccer Heroes LLC to obtain emergency medical treatment for my child. I understand that all medical expenses are my responsibility. I release Soccer Heroes LLC from any liability related to medical treatment decisions.

6. Transportation & Location Disclaimer

I understand that activities may take place at schools, parks, private or public facilities, and that Soccer Heroes LLC is not responsible for the condition of such facilities. I also understand that transportation to and from activities is my responsibility unless otherwise stated.

7. Code of Conduct & Removal

I understand that my child must follow all rules and instructions. Soccer Heroes LLC reserves the right to remove any participant for unsafe behavior or misconduct, with or without refund.

 

8. Photo & Media Release

I grant Soccer Heroes LLC permission to use photos, videos, and recordings of my child for marketing, social media, website, and promotional purposes, without compensation.

9. Program Changes, Cancellations & No Guarantees

I understand that schedules, locations, coaches, and programs may change. Sessions may be canceled due to weather, safety concerns, or low enrollment. I accept that make-ups or refunds are not guaranteed and are subject to company policy.

10. Governing Law & Venue

This agreement shall be governed by the laws of the State of Florida, and any legal action shall be brought in the appropriate court in Florida.

11. Severability

If any portion of this agreement is found invalid, the remaining portions shall remain in full force and effect.

12. Acknowledgment & Binding Agreement

I acknowledge that:

• I have read and fully understand this agreement

• I understand that I am giving up substantial legal rights

• I am signing this freely and voluntarily

• This agreement is binding on me, my child, and our heirs
